Terms of Service

Please read these Terms of Service ("Terms") carefully before using Estateur. By creating an account or using any part of the Service, you agree to be bound by these Terms.

Important Notice: Estateur Is Not a Law Firm

Estateur is a self-help document preparation service. We are not a law firm, and we do not practice law. Nothing on this website or within the Service constitutes legal advice, and no attorney-client relationship is formed between you and Estateur or any of its employees, contractors, or affiliated persons at any time, for any reason.

The documents generated through the Service are produced by artificial intelligence constrained by state-specific legal rules compiled by licensed attorneys. They are made available for informational and self-help purposes only. Estateur makes no representation that any document is suitable for your particular legal needs or circumstances.

If you have questions about your specific legal situation, consult a licensed attorney in your state.

1. Parties and Definitions

"Estateur," "we," "us," and "our" refer to Estateur, an Illinois-based self-help document preparation service (contact@estateur.com). "Service" means the Estateur website, application, document-generation tools, document vault, and all related features. "You" and "your" refer to any individual who accesses or uses the Service. "Documents" means any estate planning instruments generated through the Service, including but not limited to last wills and testaments, revocable living trusts, pour-over wills, financial powers of attorney, healthcare directives, HIPAA authorizations, personal property memoranda, and digital asset inventories.

2. Use of the Service

You must be at least 18 years old and legally competent to enter into contracts under the laws of your state to use the Service. By using the Service, you represent and warrant that you meet this requirement.

The Service is intended solely for personal, non-commercial use to prepare estate planning documents for yourself. You may not use the Service to prepare documents on behalf of third parties for compensation, or in connection with the unauthorized practice of law.

3. Prohibited Uses

  • Use the Service to prepare documents for any person other than yourself for compensation;
  • Provide false, misleading, or fraudulent information during the intake process;
  • Attempt to reverse-engineer or tamper with the Service's AI systems or validation logic;
  • Scrape, copy, redistribute, or resell any content, outputs, or proprietary legal rule sets;
  • Upload to the vault any content that violates applicable law or the rights of any third party;
  • Use the Service for any unlawful purpose or in violation of these Terms.

4. Document Generation and AI

Documents are generated using artificial intelligence (Claude, by Anthropic) guided by state-specific legal rule sets periodically reviewed by licensed attorneys. Our system applies automated validation before delivering documents to you.

Documents are available only for states we have designated as "verified." Estateur does not warrant that any generated document is legally valid, enforceable, or appropriate for your situation. We strongly encourage attorney review before signing.

5. Your Responsibility for Proper Execution

Generating a document does not make it legally effective. Estate planning documents must be signed, witnessed, and/or notarized in strict accordance with your state's laws. Failure to follow correct execution formalities may render a document void.

Each document package includes state-specific execution instructions. It is your sole responsibility to follow those instructions. Estateur is not responsible for any document that is improperly executed or for any consequences resulting from improper execution.

You are responsible for keeping documents current as your circumstances and applicable law change. Update your plan after major life events: marriage, divorce, birth of a child, or the death of a named beneficiary or fiduciary.

6. Accuracy of Information

The quality of your documents depends entirely on the accuracy and completeness of what you provide. You represent and warrant that all information you submit is accurate and complete. Estateur is not responsible for documents that are incorrect because you provided inaccurate or incomplete information.

7. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Each account is for a single individual's personal estate planning purposes. We may suspend or terminate your account for violation of these Terms.

8. Payment Terms

Payments are processed by Stripe, Inc. All prices are in U.S. dollars. The optional annual update membership (Estateur Care, $39/year) renews automatically unless cancelled. We will provide at least 30 days' notice before increasing membership fees.

9. Refund Policy

No refunds are issued once documents have been generated and made available for download. If you experience a technical error preventing document delivery, contact us within 7 days. Annual membership cancellations may be refunded within 14 days of the renewal charge if no documents have been generated under that term.

10. Document Vault

The vault is a convenience feature. Estateur is not a records custodian or fiduciary. We make commercially reasonable efforts to maintain vault availability, but we do not guarantee uninterrupted access or permanent retention. Maintain independent copies of your estate planning documents. You must not upload illegal content or material that violates third-party rights.

11. Data Storage and Privacy Consent

By using the Service, you consent to the collection, storage, and processing of personal information as described in our Privacy Policy. You may request account deletion at any time by contacting us at contact@estateur.com.

12. Disclaimers

THE SERVICE AND ALL DOCUMENTS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, LEGAL VALIDITY, OR ENFORCEABILITY. ESTATEUR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DOCUMENT WILL BE LEGALLY VALID IN ANY JURISDICTION.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ESTATEUR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. ESTATEUR'S TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF THE TOTAL AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM OR $100.

14. Indemnification

You agree to indemnify and hold harmless Estateur and its operators from claims arising out of your use of the Service, violation of these Terms, inaccurate information you submitted, or your failure to properly execute any document.

15. Dispute Resolution and Arbitration

Governing Law. These Terms are governed by Illinois law.

Binding Arbitration. Unresolved disputes shall be settled by binding individual arbitration administered by the AAA under its Consumer Arbitration Rules, conducted in Cook County, Illinois or remotely at your election.

Class Action Waiver. YOU AND ESTATEUR AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A CLASS OR REPRESENTATIVE ACTION.

16. Intellectual Property

The Service, including its AI systems, state rule sets, and validation logic, is owned by Estateur. Documents generated with your personal information are yours. You do not own and may not resell the underlying templates, rule sets, or system logic.

17. Account Termination

You may delete your account at any time. We may terminate access for violation of these Terms or fraudulent activity. Sections 3, 11–16 survive termination.

18. Modifications

We may update these Terms and will provide at least 14 days' notice of material changes via email. Continued use after the effective date constitutes acceptance.
